Pinkathon Day – Waiver

Waiver

 

I/my ward who is a minor as per applicable law (“I / Participant”) hereby declare, confirm and agree as follows

  1. The Participant has given true and complete information in this application form and I am solely responsible for the accuracy of this information;

  2. The Participant has fully understood the risk and responsibility of participating in the Pinkathon Day or any event outlined in this application (collectively “the event”) and will be participating entirely at the Participants’ own risk and responsibility;

  3. The Participant understands the risk of participating on a course with vehicular traffic, even if the course may be regulated/policed;

  4. The Participant certifies that the Participant is physically fit, has sufficiently trained and prepared for participation in the event and has not been advised otherwise by a registered medical practitioner;

  5. The Participant understands that the Participant must be of, and must train to, an appropriate level of fitness to participate in such a physically demanding event and the Participant has obtained a medical clearance from a registered medical practitioner, allowing the Participant to participate in the event/s;

  6. The Participant, including her/his legal representatives and/or heirs, unconditionally waive all claims of whatsoever nature against any and all sponsors of the event, all political entities, authorities and officials, all contractors and construction firms working on or near the course, all Pinkathon Team members, Pinkathon Ambassadors, Pinkathon officials and volunteers, Maximus MICE & Media Solutions Pvt. Ltd. and all other persons and entities associated with the event/s and the directors, employees, agents and representatives of all or any of the aforementioned (collectively, “Pinkathon”) including, but not limited to, any claims that might result from the Participant participating in the event, whether on account of illness, injury, death or otherwise;

  7. The Participant agrees that if the Participant is injured or taken ill or otherwise suffer/s any detriment whatsoever, the Participant hereby irrevocably authorizes Pinkathon to, at the Participant’s sole risk and cost, transport the Participant to a medical facility and/or to administer emergency medical treatment and the Participant waives all claims that might result from such transport and/or treatment or delay or deficiency therein. The Participant shall pay or reimburse immediately on demand to Pinkathon all incurred actual medical and emergency expenses and the Participant s hereby authorizes Pinkathon to incur the same;

  8. The Participant shall provide to Pinkathon race officials such medical data relating to the Participant as they may request. The Participant agrees that nothing herein shall oblige Pinkathon or any other person to incur any expense or to provide any transport or treatment;

  9. In case of any illness or injury caused to the Participant or death suffered by the Participant due to any medical reasons or medical condition during the event or at any time thereafter as a result of the event, regardless or not whether such medical reasons or condition shall be pre-existing conditions known by the Participant and further regardless of whether the Participant should have disclosed, at any point in time, the existence of such reason or condition to any person, Pinkathon shall not be held liable in any manner by the Participant;

  10. The Participant understands, agrees and irrevocably permits Maximus MICE & Media Solutions Pvt. Ltd. to share the information given by the Participant in this application, with all/any entities associated with Pinkathon including potential health care givers, at its own discretion;

  11. The Participant understands, agrees and irrevocably permits Maximus MICE & Media Solutions Pvt. Ltd. to use the Participant’s photograph/s, motion pictures, recordings or any other record of the event which may be recorded/taken on the event and/or during the official training session/s, for the purpose of promoting Pinkathon Day or any other Pinkathon event or for any legitimate purpose, at its own discretion at no extra cost to Pinkathon;

  12. The Participant shall not hold Pinkathon responsible for loss of the Participant’s application form and/or application fee in transit;

  13. The Participant agrees to receive information and offers of various brands/products/services from Pinkathon as may be sent to the Participant by on the email address given by the Participant in this application form;

  14. The Participant understands and agrees to the event terms and guidelines.

  15. This application form and the right to participate in the event and the rights and benefits available to the Participant under this form is at the sole discretion of Pinkathon and cannot be transferred to any other person under any circumstances.
